section 5 for removal of chimney??

    Hi, long time lurker first time poster...
    I'm planning on totally removing the chimney from my house (run of the mill 3 bed semi - not a protected structure etc).
    Its not shared with a neighbour anything like that.
    It comes up centrally through the house and out through the "side hip" of the roof. It is visible from the front.

    Do I need planning? Anyone ever receive section 5 exemption for this?

    I would say no planning required based on previous experience.

    The relevant details re planning exemptions are:

    Class 2(a) of the Planning Regulations states:
    The provision as part of a heating system of a house, of a chimney or flue, boiler house or fuel storage tank or structure.

    Section 4(1)(h) of the Planning Act states:
    4.—(1) The following shall be exempted developments for the purposes of this Act—
    (h) development consisting of the carrying out of works for the maintenance, improvement or other alteration of any structure, being works which affect only the interior of the structure or which do not materially affect the external appearance of the structure so as to render the appearance inconsistent with the character of the structure or of neighbouring structures;

    Based on those two, I would say it is exempt and a section 5 exemption would be granted.
