advise about contempt of court

    Hi all,

    Looking for some advise I was recently handed a letter at my door from a Guard that I had to go to court as a witness on a case later in the year.

    After he left it only dawned on me that the court date falls after I will have left for New Zealand for a year on a working visa.

    My question is what should I do as I am 100% leaving for New Zealand but I don't want to be charged with contempt of court which is written on the foot of the letter I was handed.

    Any advise much appreciated thanks as my worry is that for some legal reason I will be blocked from travelling to New Zealand so before I go to the station to explain my situation I was hoping to find out more info.

    (I should note that there are 2 other witnesses in this case that will be attending)

    More info needed tbh but you cannot get legal advice here. Just observations and practical suggestions.

    Practical suggestion: There's no point in going to the Garda station to explain your situation, the Garda was simply serving a court document, his or her colleagues down in the local station cannot negotiate along the lines of whether you can or cannot attend. You need to write a letter to the court clerk explaining that you expect to be out of the country at the time of the court case.

    Actually, contact the guard dealing with the case. The sooner the better, if you are a vital witness that will give the guard time to apply to the courts to have the date brought forward. Alternatively if you're agreeable the State may pay for you to return for the case, but contact the guard dealing with the case directly.

    No point in contacting the court clerk. You need to contact the party who intends to call you as a witness and discuss your difficulty. If this witness summons was served by a guard then this is likely a criminal case and you are being called as a witness by the prosecution. The Garda Station is a good place to start for finding out who you need to speak to on the prosecution team.
