    Hi,

A relation of mine owns a house which his parents are living in. 20k mortgage left, would it be possible for the elderly parents who are both on state pension only to apply for HAP with the "landlord" being their son ?

Or would some conflict of interest arise ?

    Thanks

    No. Serious conflict of interest.

You know what get them to apply they may consider it considering the housing crisis. I mean the mortgage has to be paid. You never know it could be a positive answer e.g. If parents moved out they would have to get rent somewhere else. I always say apply for everything all they can say is no.

Thanks is it listed anywhere on application forms or the like. I cannot seem to find it , where it mentions conflict of interest

The best thing you can do is ring the relevant local authority on Monday and have them explain it to you.
Here are the rules from Rent Supplement for example:

Renting from a parent: You cannot get Rent Supplement to help you pay rent to your parent if you are living in the family home. If your parent owns a second property, you will generally not get Rent Supplement for this property unless you can prove that you are a genuine (bona fide) tenant.

The son would have to be registered with PRTB the house would have to be approved by the LA the parents would have to have a rent book, be paying rent at the going rate etc the rent would have to be within the Rent limits etc
But listen. Ring on Monday it's the only way to be sure.
