Tenancy not registered it would seem

    Hi guys,

    A friend of mine is renting a property for the last 4 months,
    This property in question is not on the RTB website listed as occupied by tenants,

    Why would a landlord not enlist?
    Does anyone know the good and bad sides for the tenant and also the landlord ?

    If anyone could shed some light on the situation that would be great.

    No issue for the tenant, apart from giving them additional leverage if there is ever a problem. I'd leave it be.

    The RTB website is notoriously inaccurate. It is possible that the tenancy is registered.

    Its wildly inaccurate- Sarn is correct.
    The tenant will normally receive a letter from the RTB about 4-5 weeks after the tenancy is registered. Lack of receipt of such a letter- and lack of the property appearing on the RTB database- means precisely nothing though. Their systems are in a serious mess.

    From a tenant's perspective- they continue to enjoy all the protections of the Residential Tenancies Act- irrespective of whether, or not, the tenancy is registered. The landlord however can be fined if the tenancy isn't registered (but gains nothing from the RTB for registering the tenancy).

    Even when it is registered, the spellings are often really incorrect too. I phoned the RTB a while back to double check all the tenants were registered as some had moved in and been replaced. The spellings of even the most common Irish surnames was unique on their side

    It is important for a landlord to have a tenancy registered. Because if Revenue inspects you, the first thing they will ask for is proof of RTB registration as it is needed for mortgage interest relief

    It's the idea situation TBH. Tenant has no downside and if there is a dispute the LL immediately has an issue regardless of the merits.
