breaching access order

    I've a access order in place, just before Xmas my daughter of 15 said she wanted to stay with her dad for a break I have 2 other kids and I said ok but it could not be for good, afew days later she stopped talking to me. Dad only once told her she had no choice but to stay with me while he was on night duty and she did. Since then on 8 other nights she stayed with his family. He won't do anything to help he is breaching a court order it's a district order but my separation papers are at circuit court with this order attached. so I can't go back to district court and solictor for legal aid won't do anything as she says she is only dealing with the seperation and it could take another year to get into circuit court for separation. I need help know.

    The thing that strikes me is why your daughter wants to stay with her dad?
    How is your relationship with her in general?

    At 15 she is old enough to have a say in where she lives.
    If you and her have had a breakdown in your relationship maybe some sort of counselling would be an option (maybe even include her dad if he is willing). It doesn't seem right to run to court over every little thing, that is only adding stress on to everyone. Her dad hasn't done a runner with a 5 year old. She is 15, she has chosen to stay with her dad.
