If they have a policy that you cant carrying them over they could be gone.

    How many days was it?

id say 6/7 days?i even missed a week, of work due to sickeness, i could have used them instead of getting a doc cert and not being paid :(

So its def down to company policy then?

I'm not 100% but I think you can agree to carry forward your annual leave to the first 6 months of the following year but after that its lost if not taken (unless company policy states otherwise) . I would advise checking with citizens information.

And you didnt take any holidays at all? You are entitled to 1.8 days per month if you work full time

Op, are you full time, 5 days per week? If you are, then you are entitled to 10-12 days leave for last year.

First thing you need to do is read your contract of employment. If this says that company policy is that days cannot be carried over, then they cannot be carried over. But, the employer is required to ensure that leave days are taken before year end. Some businesses however, e.g. retail may not allow you to take them during busy periods like December do you should have taken them before that if that is the case.

Employers cannot "buy" your annual leave by paying you for leave not taken, unless you are leaving your job.

Op, get out your contract, calculate the exact number of days you are entitled to and deduct the days you took at Christmas and any other time during your 6-7 months.

Just to be clear that this refers to statutory leave which the employer is obliged to provide.

OP you should remind your employer that they are breaking the law by not providing you with this for last year.

I was sorta hoping if they were gone or reset, they would pay me for em, i mean its only fair.. but knowing the company i work for they dont miss much i doubt the contract would favor carrying em over ill look anyway just to be sure..

I am working full time by the way..

Pretty sure the statutory is 1.66 per month, not 1.8.

My understanding is that as its a statutory entitlement that the company cant just say tough luck you didnt take them. they are supposed to 'encourage' you to take them in the calendar year they accrue (its called management!), but where work issues arise it may not be possible to use all your entitlement, and they can be used in the following year. Again you are supposed to be encouraged to use them as soon as reasonably possible in the new year. All that said, as its a statutory entitlement I don't believe a company can say use them or lose them.
