DC costs awarded

    Folks,
    Asking a favour off you. Could anyone who has been awarded costs in the DC in any firearms cases recently please PM me the name of the judge and what court and year??I DO NOT need your names or any case details for this at all and privacy is 100% Just the name of the judge and when.

    Asking for a friend who doesn't post and is getting some bother with his costs in a case here down South.

    Incorrect, the District Court Rules as created by Statutory Instrument no17 of 2014 explicitly state that an order of costs is within the civil jurisdiction of the DC Judge in the case of firearms appeals (as well as approx 7 other appeals envoking other parts of the criminal justice act 2006).

    Many, many appellants have already had costs awarded, including Grizzly and the bloke typing this very post here.

    An appeal under S_15A(b) of the Firearms Act 1925, as inserted by S_43 of the Criminal Justice Act 2006, is a CIVIL matter under the District Court Rules. In civil cases, costs normally follow the event.

    That does not mean that they are automatically granted, simply that it is within the DC's jurisdiction to do so, at the discretion of the Judge.

    It's a complicated business knowing what is relevant caselaw and what has been superceded by statute etc.

    Not for the faint hearted and in the case of Irish sporting firearms law, a bit of a mess!

    Not giving you a short answer CS ,but how long is a piece of string..?Depends on multiple factors,how much does your solicitor want out of this,how good your [recommended] junior counsel is and your independant experts... All revelant factors,and how simple or complex a case?But giving you very rough on the back of an envelope calculation...Be prepared for +/- 2 grand to be handed over for a day in court.
