Gardai Vetting with a bit of a dodgy past

    Hi - If an individual was going for a manager role, through gardai vetting and had been arrested for 50g of weed (somebody dropped it onto the floor of the persons place when the cops raided a party so he got the blame as it was his place) almost a year and half ago with no sign of summons yet, would that show up on a vetting?

    Also if the same person was in court for Criminal Damage by means of arson, arising out of an incident in which a car went on fire New Years Eve five years ago, case struck out in the district court.

    Would both those show up?

    Forgot to mention there are kids where the new role is. But they are nothing to do with the persons role. They just might wander into the building sometimes.

    Only convictions come up as far as I know.

    So a weed smoking arsonist and you are gonna work with kids??


    Just kidding, convictions are what count, If you were not convicted of a crime you should be ok.
    Might be stricter vetting if kids are involved.

    Not so- any Garda intervention, the HSE or Tusla- which involves self harm, violence, dishonesty etc- is reported for any vetting which involves access to children. This came up a few times recently- for example two teachers were refused registration with the teaching council this week- because of cases involving violence which were thrown out.     The term used is 'intervention' rather than 'conviction'- so regardless of whether it went to court or not- it might feature on a vetting report- if it involves access to children........

    OP- go for the vetting- the flipside of the coin is if you don't get the vetting- any documentation is automatically confidentially destroyed (normally on a weekly basis)- i.e. the fact that you got, or did not get, a vetting- while it may affect a particular post- doesn't follow you forever.

    Certain types of incidents (violence etc) take into account your age when the incident occurred- alongside how long ago it happened- and normally- depending on the job you're going for- you can appeal the vetting if it doesn't go your way- which may work in some cases.

    I can't really comment on the cannabis or arson- but it would suggest you probably have a Garda history on Pulse which they would report factually as part of a vetting procedure. I don't know whether it would go against you for a specific job, or not- but its not going to be brushed under the carpet if your new post involves access to children.

    I work with children services and have a role of provesssing forms under the authorised signatory. You will have to declare any pending prosecutions and convictions but in my experience it is really only if you done a serious crime or posed a threat due to violence, abuse or assault that this will be held against you. TBH the one you haven't received the summons mightn't even crop up but you will need to be vetted again if you still with same org in 2/3 years and if it shows up then it won't look good.

    It would be wise to make sure that the organisation you're potentially going to be working for knows about the issues before the vetting is done, so they don't get any surprises. Particularly the one which may not show up this time due to timing, but will show up next time.

    Mrs O'Bumble - If the person tells them about the cannabis, then he won't get the role. Straight up! And he really wants the role. He doesnt feel that the charges are related to working in a kids center. Would he not be better off just saying nothing and take a chance?

    If kids are going to be involved in any way, they might be more cautious. But as far as I know only convictions matter.
