Septic tank query

    Hi just wanted some advice I recently inherited my late fathers property and land, however my father allowed his late brother to build their septic tank on part of his land. The nephew lives at the house now which was his fathers,however the nephew also built a shed on part of my land before I inherited my fathers land what are my rights concerning this, am I allowed to charge rent for the septic tank and shed being on my land

    Well your father gave permission for the septic tank, do you want to go back on his word about that ?? I wouldn't be bothered.

    As for the shed, is there any chance your father gave permission for the shed too ??

    If you think not and it's a serious issue for you then get a solicitor on the job.

    I'm sensing either some kind of unrelated family dispute or the op is not a nice person to be worried about trying to get rent for a septic tank and shed on land they inherited when the previous generation gave permission for the septic tank anyway.

    If it's that big an issue get a solicitor and sell the cousin the land it'll be better for everyone.

    If it suits layout wise, could you just sign over the area where shed is to the other guy?
    Re the septic tank, the other house has an established use of the tank on your land. I do think see how you can now restrict or remove this use or indeed attempt to charge for it. Best to sign up a wayleave granting permission to access, maintain and improve the sewage system.
    All above board then for next generation.
