Sending workers to a different shop

    Hello
    The company i work for is closing for 3 weeks at end of January and February. In these 3 weeks we have a choice of not working or being sent to one of their other stores which are 30 to 45 mins away from where everyone lives.

    Also not everyone drives so they are trying to force us of us who do to carry others.

    They have forcefully put through our holiday pay in xmas paycycle so we wudnt even be able to depend on that to cover us if we didnt work.

    I just wanted to know if they can legally do this to us without paying us as it isnt our fault shop closes for 3 weeks.

    Any information on laws that might help is appreciated.

    Op, a lot of businesses close at certain times of the year, x mass, first two weeks of August in the case of some solicitors. Employees are often required to take holiday leave during this period of closure, remember the dates on which holiday leave is taken is at the discretion of the employer. So assuming your employer has given you advance notice of the closure, you could have been told that you had to use your annual leave during this period, leaving you with very little leave during the rest of the year. Instead they offered unpaid leave so that you retain your holiday days, or temporary reassignment to another area. There is some allowable distance for relocation, I forget what it is but I think it's around 50km from original base, someone else will be able to confirm/deny this. Does the business usually close during this period? Is it mentioned in your contract?

    All seems perfectly reasonable to me OP. While not offering legal advice which I'm not qualified to do so I did spend the better part of 20 years in retail.

    op, what does your employment contract state, as it is pretty common to have a clause specifying occasional working at locations specified by the employer.

    You cannot be forced to take others to work, and indeed your motor insurer might classify that as work specific and not social and domestic.
