    Hi could someone please help me as i am stuck with this problem.
    I am a returned Irish citizen taken over to the UK at 2 years old
    and I have now returned to Kerry with my English wife and am happy.
    I had to fight for my habitual residence condition and got a job after
    being on JA for a short time but it didn't work out for me.
    So we have applied for the State Pension (Non-Contributory) and my
    wife is 67 and I am 60 years old and sent of documents they asked for
    plus a cover letter and a print off of our house rental agreement as well.
    My question is as I am Habitually Resident will it help my wife to be
    Habitually Resident and also we have never left the common travel area?

    I am British from UK and receiving JA. I did not get any special consideration for being a citizen of the UK, I had to qualify as a habitual resident through having worked in Ireland more than 2 years.

    Because you are receiving JA, your wife automatically qualifies as a 'Qualified adult' on your claim, even if she is not classed as a habitual resident.

    When you receive your pension at 66, she will be a qualified adult on that as well.

    I can't see that your wife will be able to claim a non-contributory pension in her own right if she is not classed as a habitual resident in Ireland and has never worked in the country.

    What happened NightOwl did they not accept your wife as habitually resident?

    "We" got the pension? Do you mean your wife is receiving Non-Contributory pension?

    How can you be getting it at 60 years of age?

    Are you a qualified adult on her claim or do you get Jobseekers allowance?

    Or is your wife a qualified adult on your JA?

    Or is your wife getting a pension based on her UK contributions?
