Getting paid in 2017 for work carried out in 2016

    Is this legal? It looks to me like it'd be an abuse of tax credits.

    Reason I ask is because the company I work for has an awful habit of underpaying staff due to not tallying normal hours overtime correctly.

    Payroll normally pay what's owed into the next payslip. I was underpaid this week *again*. There's a good chance it'll happen next payslip (on30th).

    If that happens will it be OK to get paid on 7th January for work carried out in December, 2016?

    Yes. Happens all the time for people on weekly for fortnightly pay cycles, which rarely fit nicely into financial years.

    In the Footnotes to Schedule E Income in the Tax Acts it refers to a case which sets out that payments are taxed in the year to which they relate so if you are paid in January for work done in December it must be taxed in 2016 payroll.

    Most payroll operators buy packages and dont know this but it's incorrect to tax it in 2017 no matter how widespread the practice
