Annual leave christmas

    Hi folks
    I work in the public sector and we have always closed from Xmas Eve to beginning of Jan. A couple of years ago some of the dept opened earlier but clerical staff were not required to work. We use our annual leave for this period. This year the dept is opening again and may require clerical staff. Annual leave has been applied for as usual but to date has still not been signed off and we don't know when or if it will be. Not all of us will be required but we don't know who will.

    Have we a case for 'precedence' or do we just have to wait and see?

    the employer dictates when annual leave is required due to shutdown.

    But the employer should also be considerate and follow the "normal" rules on applying for and approving annual leave. It may suit some folks to work over the Christmas, if it does they should identify themselves to management and any heat can be taken out of the issue.

    When this has arisen in the past the whole group organises it so one person will be in each day and it's shared around that way.

    Yeah, there's no case for precedence. Every year is different, the business gets to decide when it opens, on a year-to-year basis.

    The only thing is that a month's notice is required before they can change your holiday arrangements. So anyone with leave already booked over the period cannot now be told to change their plans.
    And anyone else can insist on coming into work if they want, but why would they.

    Anywhere I've worked, as said above, usually takes a collaborative approach to it. The management say when they plan on being open, how many people they require, and then let the staff argue it between themselves. Usually you find a couple of people who aren't into sitting around at home and would rather be in work, and everyone's then happy.
