Court has no record of the Charge.

    Hi there,

    I got a question for a relative of mine who was charged at the Garda station for dangerous driving and given the charge sheet on the day and was released on bail.

    He turned up with his solicitor in the court on the day which is shown on his charge sheet as he was supposed to be, only to find that the court has no record of his charge. The court clerk told him that they have nothing in the court system for him.

    Has anyone had any experience with the above situation? His solicitor told him the only thing he could do is wait and once the 6 month passes he should be ok (something about time frame that of the charge). Does this sound correct?

    Hi, I had the same issue a while back not with any driving related charges tho, my solicitor told me that I wasn't on the clerks list for court today so I went home, I never heard anything again from the charge (Happy Days), I know for a fact tho the 6 month thing is bullsh*t because I have been charged on things a year later in one case.

    I think he should sit tight and say noting if the Garda didn't put it through the system his own fault, not yours

    but they can always summons you to court at the later date, that six month thing is bs, goodluck with it all tho

    Thanks for the info.

    I thought the 6 month is strange as well but he was pretty sure that his solicitor has told him something to that effect.

    In terms of the charge sheet procedure, isn't that once a charge sheet is issued to you then the Grada will complete the paper work and process the charge sheet in the court system? So i suppose it would appear that whoever issued the charge sheet did not complete their paper work correctly? Nor did he/she show up in the court to lodge the charge sheet in person on that day.
