Probationary Period Contract

    Hi my contract states the following I just want to see if this appears to make sense or does anyone think it is a typo?  I just wondering about peoples advice don't want to be asking boss as I don't 100% know if this makes sense or not?

    my contract states the following about my probation period

    "Your contract is subject to a probationary period of 12 months in order to assess your suitability and skills for the role. This may be extended at the discretion of the company but will not in any circumstances exceed 12 months." 


    Does that make sense?

    It probably originally read something like

    "Your contract is subject to a probationary period of 6 months in order to assess your suitability and skills for the role. This may be extended at the discretion of the company but will not in any circumstances exceed 12 months."

    but was changed by someone in the past and no one noticed the error. Either that or it normally reads something like the above but they decided to change it for your particular role for whatever reason.

    Anyway, way it can't exceed 12 months so I don't see it as an issue.

    ok thanks just was hoping it would be for 6 months as I am hoping to go for a mortgage in January and I assumed it was 6 months probation period as it says this under my pension

    "Details of the company pension scheme will be given to you at the appropriate time and you will be entitled to contribute on your own behalf following 6 months of employment. Subject to successful completion of your probationary period, age limits and service qualifying periods you will be included in the company defined contribution pension scheme"

    and also it says in my contract that my pay will be reviewed after 6 months.


    From all the above do you think it was a typo?  I will get onto my manager on Monday but just would like some insight

    Going by the text in the contract, I'd just ask for clarification from your line manager or HR because it's a bit unclear. Can't do any harm but if they want to enforce the 12 month probation they can. How long are you there?

    Remember, a lot of these contracts are written up when a business starts up or starts to grow. Then a bit of it is changed by HR because something happens (maybe they had a bad experience with a person on 6 months probation in the past and decided to extend it to cover themselves in the future) but they forget to change another part of it. I've seen it happen in other companies.

    I will be there 6 months on the 4 of January, I know that when they were drawing up my contract they were taken over by a new managing director and had to revise the contracts so it took me a while to get it in the post.

    It just seems strange that my wage will be reviewed after 6 months and I am eligible to pay into pension after 6 months but then have said probationary period 12 months.. really thought it would have been 6 months probation didn't realise until I read contract more clearly

    Just because your wage is reviewed after 6 months doesn’t mean it will change. Could just be a box ticking exercise, a sitdown with HR to see how you're settling in.

    My feeling from what you've just said is the probation time was changed from 6 to 12 months sometime in the past but the rest of the contract wasn't changed due to an oversight.

    I am want to go for a mortgage in Jan, I am currently with the company 6 months in Jan and I do feel that I am getting on very well.. However I need to get them to fill in a salary certificate for mortgage company.  What do you think the chances are if I talk to them they can reduce my probation period for the form?  or would this been completely illegal to ask them to do that?

    I don't know the legality of doing it. I personally wouldn't ask a company to lie on a form if I was still on probation there. If you approach them they might cut your probation to 6 months if they're really happy with you? Can't do any harm to explain the situation and see if they'll reduce your probation to 6 months.

    oh I wouldn't ask them to lie on the form for me, I am just wondering because my contract says 12 months probation period is there a chance that they can reduce my probation period if I explain the situation or is there a legal point for my manager that they wont as they cant change what my contract says?

    I think you need to do a few things.

    1) Talk to your partner to decide whether he's your fiancé or husband. You call him different things in different posts yesterday.
    I want to go for a mortgage but my fiance is currently in probation which is due to end on the 4th of January 2017.
    My husband is in a year probation and it's due to end in July 2017

    2) Figure our whether he is finished his probation in January of July - again you post different things in different threads.

    3) Talk to someone in your company. Explain the situation and go from there.
