Broadband contract

    Unsure if I'm posting in the right place. Is there grounds to cancel a mobile broadband contract without a termination fee if I am not being provided with a reliable connection?

    You would have to give them a chance to fix the problem first.

    Thanks for the reply. They have admitted there is no more they can do. I've went through the whole long troubleshooting process with their non-national technical team

    You would have to give them written notice by registered post to their head office stating the reasons for breaking the contract.

    They are unlikely to accept this and they will continue to bill you. Eventually they will pass the case to their debt collectors.
    They are unlikely to go to court though.
    Bit of an awkward one as is attached to my phone account which I want to keep with them. All I can do is state my case and hold my ground! I can be stubborn!

    If they announce a price change, or any change in the T&C's, you have a 30 day grace period to cancel. December is not an uncommon time for a price change.

    Offered them the chance to settle without termination fee as they're not holding up their end of contract as not provididing me with an acceptable level of service. This is their reply




    Im afraid due to the nature of a mobile network the signal may not be strong in certain areas, we cannot guarantee strong signal for this reason. This is also covered in our T&C's.

    2.1 Vodafone shall use reasonable endeavours to provide Customer with the Service; however Vodafone cannot guarantee that the service will be fault-free.

    If you terminate the contract earlier, I'm afraid you will be liable for termination fees.

    I doubt that would hold up if they pushed it.

    Is there something in the customers rights charter to allow a customer to change to another provider if the current providers service is substandard? I had a similar problem with a mobile service a few years ago and there was no issue once the current providers service was of a lower quality than the competition.

    I'm tempted to cancel and see what comes of it as at the moment I'm using up Vodafone mobile data at home when I should be using broadband

    What kind of unreliable service are we talking about? Are we talking 4mb on a 10mb line? Are we talking constant interrupts? Is this a new issue or did it occur during your cancellation period? Taking all this into account if you think the service you are getting is well below the standard you should be expecting( within reason) then I would ask them for a reference number so you can refer your complaint on to comreg.

    Little CuChulainn there's no line, its 2x cellular products.

    Mobile broadband is a misnomer, its midband. Not really comperable to a fixed connection. I assume you're using it indoors, that's never guaranteed and the terms will state such. If you push them via COMREG its likely they will do a survey outside the house and get a steady link. No change for you.

    If your phone functions it proves reception so pretty much disproves your claim. Once they reach > 56k its currently "broadband".

    The solution isn't a legal one, its technical. Fit an external antenna to the gable of your house pointed at the local high site.
