AES Rubbish Bags

    AES for decades have sold individual rubbish bags which they would collect from the roadside.

    Would the sale of these bags in any way constitute a form of contract to supply a service?

    I have always bought them a roll at a time. I am extremely efficient with recycling and rubbish and only need to put a bag out every 2-3 months. I have been putting my bag out as usual for a couple weeks without it being picked up. I rang AES and was told they no longer will pick up bags and had ceased sales in July. I asked about being refunded the cost of the three I still have and was told I could only get a credit if I opened an account with them. I asked would I also be credited with the cost of posting the bags back to them as suggested and was told no.

    Personally I don't find their response satisfactory. Is it?

    How big are the bags? If they don't do that service any more then they shouldn't have any objection to you simply cutting off the relevant labels or holograms and posting them to them. Did they say they wanted the bags back fully intact?

    You paid in advance for a service so technically you are a creditor and they appear to be prepared to give you a refund, surely the postage isn't going to be a big deal or is it the 'principle' we're talking about?

    If a household has been given, on application, a bin exemption from the council, our collector will still pick up bags. Check if you are entitled to the exemption & if your current collector will provide a bag service to you.

    Thanks for the replies.

    It appears to be sorted now. Earlier when I posted I was told I would only get a credit to an account. I have now been offered a refund by cheque if I post the bags back to them. If postage costs less than €2.50 I'll be surprised.

    Apparently this is all a result of the elected geniuses we pay to screw us over. They decided to outlaw such bags and mandate bins.

    AES' minimum service is by weight with an €11 a month 'service fee'. So that would cost me over €132 for the 4-5 bags of rubbish I would put out a year.

    Think I will look at other options.

    Thanks, that sounds interesting. I'll contact my Council and ask. At no point did AES mention such a possibility so I suspect it may be no exemptions from them.

    It isn't the collection company that grants an exemption, it's the council.
    There are a number of criteria that have to be met, for example things like no room to store bins at your home or living on a road that is inaccessible for a bin truck so rubbish has to be brought to another collection point etc. The council will give you the list & if granted, a letter for the collection company saying you're exempt & eligible to buy bags.

    Thanks. Looks like I will be storing bags and making a couple trips to the tip a year.

    Tips cost a fair bit per bag as well plus your time getting to a bring centre. If your non recycled waste is so little that it warrants a bag as little as 4 times a month, ask a nice neighbour if you can add your bag to theirs.
