Property sale: Land registry 'Burdens and Notices of Burdens'

    Looking at a property for sale and found the following burden listed on the land registry folio:

    "... The amount owing on said Judgment is stated to be £50,513.16. Note : As between this burden and any lien on the property created by deposit of the Land Certificate prior to the date of this registration, this ranks in priority after such lien"

    It's dating back 25 years and is to do with a Revenue high court case. The auctioneer mentioned nothing about it. Does it mean that this debt has to be paid off by the person buying the property then, in addition to the selling price?!

    Actually, on reflection, I presume the seller just uses the funds from the sale to pay off the debt?

    If you are really worried about this you could ask your solicitor to investigate with vendor's solicitor.
