30 days resignation notice, was given 1

    Hi all. I done a search and couldn't find anything specific to my issue.

    I worked in the public service. 3 months ago I got a bad dose of anxiety related to the job, so went on sick leave. I subsequently said I wished to resign as I wanted to move home to be near my parents and work near home (I was 2 hours away for the last 9 years). I said I wanted to support them both with house work and financial support.

    Anyway, I was advised to take a career break to give myself the option of coming back in 1 to 5 years. Grand I said. It subsequently took 2 months to hear back, all the time I was out certified sick (it was 50% I couldn't face the job, 50% I didn't want to put my colleagues in danger/open to discipline because I couldn't do my job 100%). The reason it took 2 months is because they sent me an email for information and a date but to my work email, and didn't cc anyone, nor attempt to contact me through other means.

    So, eventually, I managed to get the email, and told them asap. So I was given a date of last week (this was about 3 weeks ago). Come to 2 weeks ago and I went in to sign the paperwork, and subsequently found out I would not have been allowed to work for the duration of the career break. This was obviously no good for me, so I handed in my notice 2 weeks ago, and as per my contract, I gave 30 days notice.

    Come to this week, and I've found out that my boss advised HR I was to be marked resigned the day after I handed in my notice.

    What I want to know is, can he do that? Am I not entitled to my 30 days? I had everything planned around these dates, and now I'm left high and dry. Thanks in advance!

    You can be marked resigned the day after, no problem there. They just have to ensure they pay you.

    Fantastic! Would you have any links to the law regarding this? I imagine I'm going to need to quote law to get paid.
