    Section 8 of The Garda Siochana Act 2005 says the Gardai need permission of the DPP to bring certain charges. Was this the case even before 2005 as it is mentioned in the case of Brian Rossiter.

    I have no involvement with the Rossiter case or any case. Just wondering why if it was already the case pre 2005, it is mentioned in the 2005 Act?

    Yeah, there were numerous rules, such as hybrid offences if it was going to be sent forward for trial etc, the Garda Siochana Act just compiled them together. The 2005 Act made very little difference in practice, it was pretty much a case of as you were.
