Question on boundary lines

    I just have a question that maybe someone might know something about. In a housing estate that was built 10 years ago can a neighbour query a boundary line after we have both bought a house?

    Basically our neighbour mentioned in a throwaway comment that our roof comes slightly into their space. (like about an inch or two max)

    My question is could they even raise that as an issue now, considering it was a developer who built the estate 10 years ago, we obviously would have had no say on the roofs of houses (nor would any of the other neighbours) and we both bought our houses on the basis of engineers reports etc

    They are building an extension to their house and want to join their roof to ours. We have no issue with it as long as we have it in writing that they will cover if there was to be any water damage, leaks etc down the line. Which is fair enough considering its their extension etc

    Would they have any leg to stand on at all with this whole boundary comment? I would have thought no, but then again have no experience with this type of thing.

    Its more a legal issue.
    Does your roof oversail the boundary?

    If it does, then they can seek civil action IIRC but don't quote me on that, its a civil issue that would have to be resolved between both parties or through the court, and you don't want that!

    With regards to the leaks down the line, this is not something that they will stand over indefinitely, at some stage, wear and tear sets in and it will revert back to you being responsible for your own leaks etc

    As in the other thread, request a drawing of the finished works and the best thing to get is a parapet wall as this clearly lines the boundary, and your roof is one side, and theirs on the other.

    Never noticed that our roof goes partly into theirs before & it never came up in our engineers/ surveyors report a few years back when we bought the house. All the houses in the estate are built the same too.

    Definitely want to avoid any court or other hassle, am 7 months pregnant and have enough going on. Why is nothing ever straight forward!
