Dangerous Driving Query

    Hi All .

    I was involved in an incident while driving today near Mount Merrion and need some advice .
    I was driving off from a parking and went around the parking to take one of the rear exit . I slowed down a bit since I wasn't sure of the exit and then turned left to approach the exit . As I was moving out to the exit on the right I saw a car heading straight - immediately stopped and let the car go on . It was a minor road in a housing estate and probably I should have seen the car much earlier .
    The girl driving was mad at me and said that she would be reporting this to the guards. It was my fault altough I did had my breaks on well in time before it becoming dangerous by in any means.
    Anyways I apologized , she sweared and we went our ways .
    Later on I call the local garda st and told them about incident as it happened . They took my contact details . He did however say that this dosent seem to be case of reckless driving and that they would be in touch with me if there was a complaint made and if they investigate and carry it further based on their investigation ..
    What do you think should be done in this case . Penalty points and added insurance would break my back .

    Legal advice cant be given however i dont see my next part as being advice but more common sense.

    If there was no accident amd no one else around then its your word against hers and the guards wont waste their time on hearsay especially as there was not rta,forget about it and move on

    How do you know that the other car wasn't speeding ?

    It's not a good idea to accept full responsibility for an incident without knowing all the facts.

    No collision, no personal injury, her word against yours - you say you braked in plenty of time, she seems to think differently. The cops will not prosecute in this case, even if she reports it which frankly I doubt she will. She let off steam giving you a bollicking, it's highly likely you'll hear no more about it.

    You say she swore at you - counter with an accusation of road rage if a cop shows up on your doorstep to investigate the incident.

    But it's completely crazy to be ringing your Garda station and drawing attention to yourself based on a threat from a hothead motorist who was having a bad <<mod deletion>>day

    Maybe OP told indignant lady that his name was Donald Trump and that engendered the ire.

    On a point of general principle, there is rarely an absolute right of way as between vehicles. Both parties in this type of situation have obligations to exercise reasonable care. The right of way / stand on vehicle is not entitled to push on heedlessly. Unfortunately, some people have a rigid view of right of way as meaning that they have an absolute entitlement.

    Again, sticking to general principles, OP probably did not need to report this type of incident to Gardaí but was perfectly entitled to do so. That said, Madam might be surprised to hear that it has already been reported if she goes that far. On a practical level this should go nowhere.

    OP might I suggest that you write down everything that you remember including verbal interchanges and keep that note in your computer or elsewhere just in case there is comeback. I suggest this as recall can be notoriously problematical in these matters.
