Off the road

    So im off the road for 6 months but I think (morally not lawfully) I may have a dispute.

    On my last provisional licence in 2008 I acquired 2 penalty points and another 2 in 09.

    My licence expired in 2010 and I moved to dublin so never got it renewed until this year. so I had no licence for 6 years.

    Now, I moved home and applied and got my licence in June. About a week later I got 3 penalty points for speeding (just my luck) and I have been put off the rd for 6 months.

    The reason they gave me was the points on my licence carried over as I had no licence, so in licence terms, I have acquired 7 points on my licence in less than 2 years putting me out for 6 months :(

    Anyone here think a letter or appeal would be in order in these circumstances or is it just my tough luck.

    It's all about dates and timing. Your learner permit is only valid for 2 years. Once it expires, then the clock stops, until you get your next permit. That is my understanding anyway.

    So, sounds like you just lucked out.

    Similar situation to the OP. Exchanged my Irish licence for a foreign one when I moved away. I recently applied to get my Irish licence back...no problem. Got caught speeding a few weeks ago, paid the fine and received my 3 points...on the bottom of the letter it said that my total points were now 5! Confused I rang the appropriate number and was told it was correct as I crossed a white line in the Jack Lynch Tunnel in 2005. So I've got two points from eleven years ago. The system is a total and utter joke.

    Thought penalty points remained on your licence for 3 years only.

    The same applies to driving bans. If you are put off the road and in the meantime your licence expires, your driving ban is put on hold until you renew your licence.

    If the licence expires during the course of the ban you simply can't apply for a new licence until the ban has run its course. Bans do not break when a licence expires, however any endorsement/penalty point times do and I suspect that is where your making the error Donutz.

    My mistake so. I recall years ago of a friend who was in this situation. Maybe my memory isn't as reliable as it used to be.
