Question for purchase of petrol

Is it legal for a person under the age of 18 to purchase petrol/diesel from the petrol station in a container like a jerrycan? For example if your parent/guardian needed petrol for their car could you go up to the station on your own and purchase fuel for them.

Sorry if I posted this in the wrong section or something I'm new to this forums site

Fuel cannot be dispensed by anyone under the age of 16.

    Welcome to Boards.
I've moved this thread into the Legal Discussion forum because it's not suited to Dublin County North.

Considering we are getting near bonfire season, it would be somewhat irresponsible of a garage to sell fuel to children.

The law would apply to under 16's.
The garage would have no proof that it's for use by a parent to get their car started.

The issue raise in the OP is not who the fuel is dispensed by; it's who it's dispensed to.

There's no law preventing the sale of fuel to an under-18 year old. (Hey, you can get a driving licence for a car at 17, and for certain motorcycles and tractors at 16; you have to be able to buy fuel for them.) Nor am I aware of any rule banning the sale of fuel to under-16s, though I suspect some garage owners would have a policy of not doing that.

I think S66 (c)(i) of the Dangerous Substances (Retail and Private Petroleum Stores) Regulations 1979 would cover the "by" and "to" to anyone under 15 at least.

It's possible the age 16 requirement is a licensing requirement under the Auto Fuel Traders Licence rather than a specific legislative requirement meaning a violation may come under the Finance Act?
