I have a car for sale, no tax on it since end of july, do I have to declare it off the road or will I just leave it up to the person who buys the car from me? I have not driven the car since end of July.

You're liable for the tax up to the date of sale, don't think you can retrospectively claim the car was off the road that loophole was closed afaik. The new owner is only liable to pay tax from the date ownership is transferred to them.

You would have to pay the tax for the last 3 months as you can only declare it off road in advance.

Once you sell it the arrears are written off and the new owner taxes it

I remember when I bought the car back in 2013, I just went into the garda station and filled out a form to say it was off the road for the two months previous.

    When was the loophole closed?

I sold a car 2 yrs ago, same situation, no issues.

The tax arrears go away when you sell the car and sign the car over to the new owner.

Yes you can claim the car off the road now but you can't back date it. You will be liable for any tax due up to the date of declaration.

If the car is not being used and not parked in a public place until sold then I cannot see a problem.

Just wait for the new seller to buy the car, then the tax arrears disappear, you don't have to pay them if you are not driving the car.

New owners pays tax from the start of the month that he buys it.

When you sell the car, any tax owing is wiped.
The new owner pays from when they buy the car.
Just don't have it on the road.
You must declare off the road in the last month of the current disk or within 21 days of buying a car.

this is correct , you need do nothing if YOU are not putting the car back on the road. Tax for new owner only due from first of month of purchase.
