Canot find subsection of Act

    I was reading something which referred to subsections 5 and 5A of section 4 of the Criminal Justice Act 1984 in relation to re arrest after acquittal. I do not see any 5A athttp://www.irishstatutebook.ie/eli/1984/act/22/enacted/en/print#sec4

    NOTE: This has nothing to do with me and I am not involved in any legal matters. I just wondered why I cannot find it

    When you see a suffix as in '5A', it means that that subsection was added by a subsequent amending act. The Law Reform Commission has a section where they publish the up to date (amended) version of a lot of acts and there are annotations indicating the amendments.

    You'll find the answer to your questions here, note the the list of sections at the top are all clickable links so select the sections you're interest in rather than scrolling, it's a very long page with all the annotations....

    4 (5)(a)
    5 (A) If at any time during the detention of a person pursuant to this section a member of the Garda Síochána, with reasonable cause, suspects that person of having committed an offence to which this section applies, [other than an offence to which the detention relates or an offence in respect of which the person’s detention has been suspended under subsection (3A)], and the member of the Garda Síochána then in charge of the Garda Síochána station has reasonable grounds for believing that the continued detention of that person is necessary for the proper investigation of that other offence, the person may continue to be detained in relation to the other offence as if that offence was the offence for which the person was originally detained.

    It's the old subsection 4 (6) which was originally inserted by the Criminal Justice (Miscellaneous Provisions) Act 1997, which was then renumbered as 4 (5)(a)by the Criminal Justice Act 1999 and then amended by the Criminal Justice Act 2011.
