Mortgage and separation

    Hi,
    Asking here in case somebody was in a similar situation and wouldn't mind sharing their experience.
    A bit of context: My husband and I split up a couple years ago, he went back to his own (non-EU) country, leaving me and our child here. He doesn't pay maintenance or anything (but then again I was always the one making most of the money), and there is no official paperwork in regards to our separation.
    I'm hoping he'll start the divorce proceedings in his country, but if he doesn't then I'll do it here once the 4 years are up.
    Now for the current situation: I've always been a renter but I am now looking to purchase (with a mortgage of course) an apartment for my child and I. If I did so before the divorce was final, would my ex be entitled to half of the property?
    I'm wondering because if that's the case then I'll just keep saving and reluctantly renting until that's done and dusted.

    You say it's not official...So you are still married?
    If your still married it might be worth holding off the purchase until you receive your divorce.

    Yes we are still married and we don't have a judicial separation agreement either. He did leave the country 2 years ago, has a job over there, and is not supporting our child financially whatsoever.
