Dealer not done change of ownership yet

    Hi guys,

    Perhaps you can help me out here. Myself and the mrs bought a car last month. The dealer has yet to get the ownership/logbooks changed over. This has been nearly a month going on now and every time I call him he keeps saying it should be sorted in "x" amount of days, but between one excuse and another it never is. The last time I rang he said "he has to check with his accounts to see ". Is there something unscrupulous happening here? All the time my car is still without tax with the risk of being pulled over.

    Any advice would be great here.

    how about taking your new motor out for a good auld spin on the M50 for the day .. probably about 10 passes through the toll each direction might let you vent your frustrations.

    And when the registered owner of the car received the fines for late payment they may actually do something about sending off the change of ownership

    It sounds like the dealer didn't get it from the last owner and now is fobbing you off in the hope that you do the donkey work around sorting it out.

    So you have two choices, you can either go down in person to the dealer (phone calls seldom work) and torment them into sorting it out with the previous owner or you can go through the process of getting a Peace Commissioner/main dealer sign the below declaration form which allows Shannon to contact the previous registered owner and inform them that they are transferring ownership over to you. If they hear nothing back from the previous owner within a certain time frame they then proceed to change the ownership over to you.

    It's really up to you which way you want to go and how much time and effort you want to spend tormenting the dealer versus just sorting it yourself.

    How is it possible for a dealer to trade a car without proper paperwork?

    That smells tax evasion for miles...

    I have no idea how dealers manage their paperwork for tax purposes but buying cars without the old vehicle's registration cert is very common for a number of reasons including the previous owner either lost it or didn't bother to give it at the time of sale.

    As already mentioned, If you are anywhere near the M50 just one or two trips should have this sorted within a week. We have had to resort to this twice and we live in Co. Limerick (although both times we were going to Dublin shortly after buying the car).

    Did you do a history check on the car? Is there still finance outstanding on it from the previous owner, which the dealer is supposed to be clearing off the car?

    It being common does not make it right.

    The dealer has no proof he has legal right to dispose this asset, it might be as well stolen...

    I hounded the dealer I traded my car with for 4 months to change the ownership. Got it sorted eventually

    But I never said it was right, all I am saying is it's what happens. It's the system in place that is flawed that allows it to happen.

    I had similiar issue when i bought my car. Dealer said they sent it in but no record of it. Dealer had to go to tax office and pay for duplicate logbook an then get me to sign it again. Had the car 3 months at that stage.

    Yup, Then the change of ownership will be sent off with correct dates, The M50 toll/fines will be passed to the new owner/the OP?


    How is that sensible?


    I'v had a speeding fine and M50 toll (Both on the day the new owner collected it) Replied to both with copies of Log Book with new owner details...
