Problem with childrens allowance transfer

    My sister has full custody of her son for the past 3 months (all done via courts). She is still waiting on the children's allowance to be transferred to her. She was given a number to call at the local sw office and they keep saying the transfer is pending. A week ago when she rang she was told her ex partner would have to write to them to say he is no longer collecting it. I would have thought that court papers would have sorted this, but apparently not. Is there anything she can do? Her ex is still collecting the money.

    If it's not signed over willingly it might have to go to court .

    A court custody case usually doesn't involve who gets what welfare benefits ,have her speak to her solicitor

    Thanks. Though it's actually my brother, rather than my sister. I opened this thread 3 days ago and it got 98 views with no reply. Then my brother laughed and said if it it's a woman in trouble, you'll get a response right away. I hate to say it, but 6 minutes after posting the exact same story, exchanging only man for woman, a reply came in. Not a reply of sympathy, but a reply none the less. Coincidence perhaps, but he was right and I owe him €5 now :mad: ( not that I will be held to it ;) )

    I thought the parent with full custody receives the childrens allowance though. It goes to the mother by default, so why the complications and need for court when custody has been transferred? It's for the child after all.

    It's one of them subjects that people might not have experience in dealing with custody and child benefit ,

    He had to drop the enterprise allowance and the SW are giving him the run around. It's a very very long story, but suffice to say they have everything they asked for and each time he goes up, they ask for something else and promise to call and nothing happens. The EA was cut a few days ago and his JSA has not come through. In fact, they "lost" his claim and then found it again, but he still has no payment. Due to some heavy expenses, I am unable to help and I just got a message to say his electric got cut off because he has no money for the meter. Total sh1tty situation, he seems to be getting the crap from every angle. 1 step forwards, 3 steps back.

    He applied for relief on Monday, but they have not yet called back after promises that they would yesterday and today. I might write a book.

    I read the original thread, I'd guess like most people who read it I didn't have any advice and legal advice isn't permitted anyway. It seemed pretty pointless to comment and say I don't know.

    Your brother needs a solicitor.
