Directing Traffic?

This is purely a hypothetical situation, a what if?

As I recall, the only people who can legally direct traffic are: Gardai, road works and lollipop person.

At the weekend, I was up in one of the big shopping centres and it really was bedlam. Security were doing their best and were standing in the middle of the road directing cars and making the best of things.

What would happen if there was an accident, or a driver followed their direction and hit someone who had "right of way" as per public laws.

Would there be a different set of laws as its technically not public property - or are the roads in Liffey Valley / Blanchardstown / Carrickmines etc etc classed as public?

Just curious on this one. IT IS NOT REAL :)

It is an interesting question, thanks for that.

I have to say that the answer is rather boring, though. So much so that I'm not even going to bother. :p

According to the law the driver as they are responsible for everything they do. H&S would have an issue but I don't think the person directing could be prosecuted.

I live in the UK and a club I am a member of closes a few roads for events, We have to get in a specialist company as you need a cert now to manage traffic. Costs us a fortune its a right pain the arse.

People in charge of animals are also entitled to direct traffic, as for the shopping centre dilemma I would have thought that an employee of the SC would be allowed to direct traffic in the grounds and car parks. If there was an accident and damage it will be covered by the car-park owners once negligence can be shown(if the security guard had not been given any instruction on directing traffic). Otherwise the driver follows the direction at their own risk and if in doubt should stick the handbrake on until the area they are directed into is safe to enter in their opinion as the driver.

Defence forces personnel can also direct traffic. I am not sure about road works. I have never seen any statutory authority.

A few weeks ago I was first on the scene of an accident and after checking everyone was OK, I directed traffic. I thought that was what you were meant to do, sounds like I was wrong?

shopping centres et al are private property though right?

also when driving you have the right of responsibly for you and your car so you cant blame a security guard if you crash into someone.

    As a aside
anyone who has directed traffic for any amount of time will quickly realize how truly stupid human beings are .
