N1 Business Class 5 Seater and VAT recovery

    Purchased a Toyota Landcruiser 5 Seater Commercial in 2015 through my company for 100% business use towing trailers, carrying goods and passengers for a tourism business. A recent Vat inspection ruled that I need to pay ALL of the vat back as inspector claimed that the vehicle does not classify as a commercial vehicle and cannot fall under vat reclaim under the company car commercial scheme as emissions are too high. Vehicle registered, taxed, insured as a commercial and I pay commercial rates going through tolls. Think it's a misunderstanding on part of vat inspector when seats were spotted and they consider it a car. Anyone have a similar experience or know of a way of pointing out that it is a commercial?

    Currently the rule is according to http://www.revenue.ie/en/tax/vat/leaflets/vat-and-vrt-on-motor-vehicles.html#section44

    " Any VAT-registered trader is generally entitled to reclaim VAT charged on the purchase of a motor vehicle for use in his or her business if the vehicle comes within the definitions of Category B or Category C vehicles for the purposes of VRT. If such a vehicle is used exclusively for business purposes, a full refund of the VAT is allowed."

    Assuming you bought it as new from land rover, one would assume they had it signed off my an engineer that it met the specifications of an N1 5 seat commercial vehicle. Request a copy of this certificate from land rover and that should be sufficient for Revenue.
