4 month driving ban in europe can I obtain my license from Ireland if I returned to I

    I have just received a four month driving ban in Europe and will get my licence back in December. My question is: by coming back to Ireland how will I receive my licence. Must I stay in Europe until December? I just need advise on this matter or who should I possibly contact with regard to this query. Ta

    Interesting question but Europe is a place with many different countries all with different criminal legal systems.

    just an irish driving licence and it happened in france

    You have been disqualified in France and you have surrendered your Irish licence there. I presume that you have not been disqualified in Ireland but you may correct me if I am wrong.

    Not wishing to cross the line to give legal advice (which is not allowed by forum charter) but if you are not disqualified in Ireland, is there anything to stop you from applying to replace your Irish driving licence in Ireland?

    I see that NDLS will replace lost, stolen or damaged licences but your licence has been confiscated by the French authorities. Perhaps you could ask NDLS about your situation.

    I presume that the OP does not wish to put himself in such a position. Therefore, the suggestion was made that that he should enquire of the NDLS whether they would agree to replace his licence, in circumstances where it has been confiscated by French authorities.

    I wonder is the driving licence similar to the passport in that it's effectively property of the state? Should the French authorities be surrendering the licence to the local embassy?

    The way it works in Austria is that your licence is returned to the embassy on completion of any ban. You have to travel to Vienna to recover it.

    If the licence is not retrieved within a certain time scale the embassy returns it to NDLS and they void the licence.

    It happened to a business associate of mine. He tried to be cute and told NDLS that he had "lost" his licence.
    He wasn't so cute when about 6 months later the embassy returned his original licence to Ireland. This was followed by a "please come in for a chat" letter.

    Give the RSA or the NDLS a call. They'll advise you.

    Another problem, I have received a document to change to a French licence. I don't want to as if I decide to return to Ireland I want my Irish licence. If I wait to get my Irish licence back after 4 months then I can go to Ireland with my licence.

    the thing is, you are perfectly entitled to drive in France with your Irish licence as long as it is valid, however, as soon as you get points, a suspension or a disqualification, then you are obliged to exchange it, which is very possibly why they kept it and have now sent you the paperwork in order to finish the exchange.

    Once done they will then send you a French licence, which you will then able able to exchange back to an Irish one in due course.
