Grandparents, guardianship and custody

According to the new law that came into force earlier this year grandparents can apply for guardianship and custody of grandchildren.
If a child's father was dead can his parents easily get guardianship or joint custody of the child if the mother strongly objects? Could they stop her emigrating in this way?

    Thanks
