Planning regs - can size of small room to be knocked be added to 39.9 extension ?

    Hi all,
    I have a small utility of about 6 square meters. I plan to knock this and then build an extension, some of which will be in the place where the utility currently is.
    My query is: can I then build an extension of 39.9 square meters plus 6 square meters = 45.9 square meters without having to consider the new building regs?
    The real extension to the house is 39.9 square meters, so maybe it would be outside the limit where the new regs kick in?

    Was/is the Utility Room original to the house?

    A bit of a grey one, but, I think you might be o.k. as long as all other requirements for exempt development are met. Note that is my opinion - others may have other opinions.

    If there is any doubt, apply for a Section 5 Declaration (you can Google that or look at your local authority website).

    You should be getting your extension 'signed off', at the end of the works, as in getting an opinion on compliance with (exemption from) planning permission, so, you should consult whoever is going to 'sign off' first to get their opinion/get confirmation they are happy.

    When you apply for planning the form will ask for

    Existing floor area
    New floor area proposed
    Total floor area of new & proposed.

    As long as the total minus the existing is less than 40 you should be fine, but don't forget you can opt out of the new Building Control Reguations under SI365.
    The first thing building control do is cross check the grant of planning permission to ensure short form/long form compliance.

    You will still need to lodge a commencement notice through the BCMS though.

    Yep 40 sq.m is the rule of thumb. Off topic but some what related. I has advised an agent that proposed works fro his query would be exempt. He lodges commencement notice but the building control lads were saying needs a planning number, glitch in the software and we're asking me about whether it needed planning. Have you come across such before?

    Yeah many a time.
    If it didn't need planning, it didn't need a commencement notice.
