Planning and Retention

    I bulit my house 5 years ago. It's a bungalow with full planning. When we built however we also opened upstairs (attic). There are four windows, just Velux in the back roof. We are in the country so don't overlook anyone. Even if we did you would have to be 7 foor to see out the windows.

    One of the attic rooms we want to turn into a proper bedroom. However for safety I would like a "normal" window. So I was planning on putting a window in the gable. I don't think I will have issues with the neighbours, but would like to do it by the book and get planning.

    My issue is will I run into problems getting planning for a window that has an upstairs that has no planning? I have heard about the 7 year enforcement rule, so should I wait till then?

    The 7 year enforcement time frame does not mean that the issue goes away, it may come up in any pre-sale survey its just they can't enforce it.

    There is planning compliance and then building regulation compliance

    The more important question here is if you have the headroom for creating habitable space in the attic.

    If not, then just describe the existing and proposed as storage, job done.

    The two attachments are from the same house, the upstairs bedrooms failed the habitable room tests so shown as Attic space.

    Just get a local arch to submit velux for retention & new window for permission. No problem
