Caught with a joint

Hi guys, I was wondering if some of you guys could give your opinion on this situation please.

One evening, myself and two friends got caught smoking a joint by two undercover guards. At the time the joint was in my hand. However everyone accepted responsibility as we were all smoking it. They searched us and we had nothing else on us bar a grinder with no weed in it. They took all are details and said we might get a court summons?

None of us have ever been in trouble before.

Thanks for the quick reply, yeah I suspect we will be fine but I have a feeling I'll be summoned to court as it was in my hand and I had an empty grinder.

You won't get a court summons. If you do the judge will tell you to leave and scald the garda for summoning a citizen over such a minor infraction. My friend was brought to court for possession of about 3g of weed and the judge did exactly that.

They were just putting the fear in you

Hopefully you won't have any issue, may have been a scare tactic on their part, it's not like you were running away or hiding the fact of what you were doing...

It would be a very unfair guard to summon you for smoking a blip and taking a grinder off you, but hey, I know someone who got a 500 quid into the poor box for 2 grammes of weed and a first offence ..

It's at the guards discretion really, if you do get summoned I would try calling into the cop and apologising etc, may help you out down the line

I have never seen this reaction from a judge in relation to a prosecution for possession of cannabis. Furthermore it is not possible to predict the judge's reaction, without even knowing the judge.

This is not good advice.
