My car was hit in car park - advice needed

    HI,

    A few days ago I was sitting in my car in a car park when a guy came flying back reversing and hit me straight in drivers door, he admitted liability and gave insurance details. Now he hit me so hard he pushed my car up onto a kerb and the door is completely bent and won't close properly and the passengers side door made contact with a bollard but that's repairable,.

    At the time I felt ok maybe shock or whatever but iv had to visit the doctor with my back and knee where it hit and cracked the centre console, and neck from the jolt of impact.

    I'very never had a claim for or against me in my life so I'm not sure how to proceed I'm a toolmaker which requires heave lifting and manual work, which I'm unable at the minute to do. I'm worried about long term damage and not being able to work pay my mortgage support my family etc

    And advice on how to proceed would be great

    contact a solicitor, and put in a claim and he will put forward the claim for you. Be prepared for him to admit nothing.
    All well and good when they admit it in front of you, after a few days their memory tends to fade.
    Hope theirs cctv covering it as well.

    Also be prepared for a backlash on here. I presume they're all fast asleep at the moment, but they'll, come down hard on you in a few hours for daring to make a claim for personal injury based on an injury you suffered.

    1. Report the incident to the guards
    2. Follow up with your GP.
    3. Contact a solicitor.
    4. Follow the advice given.
    5. All contact between you and the other party or their insurance company through your solicitor.

    We'll it's impossible for him to deny unless I came sideways across a green and hit the back of his car.

    The backlash crowd can do one, I've never claimed for anything and iv been hit a few times but my car is destroyed and I'm genuinely in pain hence the time I posted. Anyone who says the wouldnt claim are lier I have paid insurance for 20+ years and never needed thank God and seen a 20% rise this year.

    My career and home is at stake here will the backlash crowd pay my wages and mortgage oh and fix or replace my car? Any snide posts will be reported in asked a genuine question in the appropriate forum not after hours

    Contact your insurance company as well in case you haven't.

    They'll get an assessor out to look at both cars before his is repaired, his evidence can be useful in case the other driver denies it.

    Buy a diary and write down every day how it affects you... Work, home, recreation, pain etc etc. It will be useful in the future when dealing with medics and the court case in case you forget something.

    I feel for you OP, I just recently settled a claim from a motor accident in 2009. My first accident and first claim.

    Get onto a decent solicitor, technically you don't need one for PIAB, but the insurer on the other side will have one and your at a disadvantage not having one. Also I was being harassed by the other insurance company with phone calls up to 11pm at night.

    I have life changing permanent injuries, lost my job on the back of it and now work in a lower paid non manual job. But the insinuation from people when you are making a claim is a wink and "the old sore back routine".

    Make sure you lock the messages as some phones will automatically delete older messages. Make a copy of them somewhere else too, backup your text messages. Take screenshots and save them somewhere besides on the phone.

    If its a genuine injury then why would people backlash?

    Insurance exists to protect people from financial losses they may suffer because of the actions of others.

    If the poster came on here and said he was feeling fine but fancied a few quid then there would rightly be a backlash however he has said that he is hurt so we have to take him at his word.

    As is often the case, the symptoms of injuries don't manifest until hours after the event when the adrenaline and shock wears off.

    People make mistakes and hopefully in your case other driver is decent.

    Oh I know he didn't mean to hit my car but I noticed as he got out he'd a mobile phone in his hand so possibly on it and not looking if you can pm me the solicitor it'd be great

    This guy is pushing to pay outside of insurance and at the moment I'm in hospital with dislocated shoulder needing surgery

    Would I still be able to claim for my injuries if he pays cash for damage to my car?

    If you are lodging an injury claim then do not accept a single cent from him for anything, that will completely prejudice your position.

    Tell him him any further conversations go through your solicitor. Consider installing an app on your phone to record any conversations that he has with you.

    How will insurance company value my car is it only scrap value or pre accident Value? I spent the whole weekend with a dislocated shoulder couldn't take it anymore last night

    The only communication will be solicitors and insurance the guy is a bully trying to get me take €500 for damage he says was only doing 2mph but did €2800 of damage to my car
