On Phone while driving

    Hi, I was caught on the phone by a guard recently, he took my licence and address and asked me to drop in my insurance cert to the nearest station. No mention of penalty points or a fine, is it possible when I drop in the cert that they will hit me a fine and the points?

    You'll get a fixed penalty notice by post.

    Production of your insurance is a totally separate matter, the Garda who notes your insurance details in the station you nominated won't know or care about the mobile phone incident. Just tell him/her roughly where and when you were stopped and show them the cert, nothing else to it.

    You should be getting a €60 fpn in the post and 3 penalty points on your licence.

    Do they normally take those details if they're going to send anything. Had a run in there the other day and nothing was taken, just some words had. Will I get a summons off the reg of the car. I'm not sure it can be dealt with by a FPN.

    You forgot to tell the OP that the original Garda will process the fixed penalty seperately and it will arrive in the post in the next few days.

    I didn't 'forget' anything, the FPN issue was adequately covered by the first response from L1011.

    Thanks for the responses, thought he would have mentioned something about points when giving back the liecence and asking about the insurance cert! Oh well

    If you were stopped at the side of the road then the Garda would typically note your details, otherwise they would have the ridiculous situation where they would need to formally ask the registered owner to state who was driving the car at the time which typically only happens when you are clocked for speeding by a camera or someone reports you for dangerous driving.

    So if you are going to get a FPN and/or points, they will ask the driver for name and address. Otherwise it sounds like you were let off with a caution.

    Thanks Coylemj. I think it was just an on duty Guard who didn't appreciate my speed on the M50. He had a couple of guys in the back (guards) so I assume they were doing something else and it wasn't traffic.

    The guy was quite stern but I was in the wrong and I was respectful to the guy, so fingers crossed it was just a slap on the wrist. I absolutely crawled back home so job done!
