Seats lifting in 3 door car NCT

I have a 3 door 2003 Fiesta. The seat handle are broken in most I've seen including my own. To gain access to the back seats, I have to pull the handle in a certain very awkward way. Will this be a fail for the NCT? Seats not lifting to give access to the back seats? I know I can take the back seats & belts out temporarily…

I know I can take the back seats & belts out temporarily to pass but I'd rather not.
