Query on whats considered a future asset

Currently going through a acrimonious separation and preparing for circuit court, I'm well aware that future facing assets pensions/investments etc are all up for negotiation and likely a split of some kind will be worked out through the courts. However my OH has a substantial inheritance on the way (promised to us both during our marriage) and I was wondering if this was something that falls into the future facing assets (like a pension etc..) and if so could be put on the table for discussion/negotiation

    thanks
