Garage car: no tax or nct

My car is in the garage at the moment. It is undriveable until it gets fixed.
The garage owner gave me the use of a car today while mine is being fixed.
My insurance covers me to drive a garage courtesy car for 7 days.
But when I looked this evening I saw that the NCT is out since February and the tax is out since May.

I'm just checking, is it the owner of the car or the driver that would be liable for fine/penalty points in this situation?

    The driver.

Your insurance might not cover you if it doesn't have an NCT, check your policy documents.

    Thanks. I thought so.
As a supplementary, if I get the owner to buy the tax tomorrow and to book the NCT, would that be sufficient, or is it illegal to drive when NCT has expired even if you have an appointment booked?

It's only legal to drive home from the NCT without an NCT. Only other exemption is if it came off an Island with no bridge. You might get past the Gardai with an appointment but insurance policy if it requires NCT definitely won't cover.

It's actually the driver and the owner.

Surely the offence (in both cases) is Driving the Car without a current NCT, and/or Tax.

Bring car back, and demand a courtesy car that has tax and NCT, otherwise you'll pay for their mistake.

    Thanks.
I'll have to bring the car back (and hope nothing happens on the way).
But he is a 2-man operation, so this is the only spare car available. So I will have to go without car.

Might be a good idea to check the tyres aren't bald too and you end up with a full house of offences.

Just an afterthought; if you use the garage regularly and trust them, then cool, otherwise if they didn't bother with the NCT or tax due to money issues and decided to cut a few corners, I'd get your usual mechanic to give it a once over to ensure no corners were cut to save a few bob.

Thanks. He is a pretty decent guy and I think that he knows his stuff and is conscientious about repairs (as far as I can tell). He doesn't really do courtesy cars (just a small garage), but just happened to have this available. When I brought it back, he apologized.
