Garage Space

    Hi,
    I hope someone can assist me in finding out my rights in regard to a garage space that was allotted as part of my home when I purchased it. The space is opposite my home in a green area. On the Deeds it is clearly marked as a garage space. over the years I grow roses in the space but only at the boundary wall. The city council have been cutting the grass in the area and started cutting the grass in my garage allotted space some years ago. The grass are is in a common area that tapers off sort of a half tringle in shape. I now wish to build on driveway not a garage but a place to park my sons car in that spot. question:
    1, do I need planning permission.
    2, Can the city council claim the area as they will say they were cutting grass in the area.
    basically where do I stand legally or are there pit falls here?

    Council probably not aware that they don't own this plot or should cut the grass there. Use as garage has lapsed for a long time, is a green area and could be zoned as such. Planning needed and may be difficult to obtain. Seek a pre planning meeting, bring in your deeds and outline your info to them, and heed their advice.

    thank you for your prompt reply, but if you purchased the land as stated in your deeds you own it. Is there a law stating that you must use as a garage space or build a garage on it, is there a time relative here?. It that not like saying the green space on you fount and back gardens are open to be taken over if you only have grass on them. Just cant get my head around it I assumed that once you own the land then its your land?

    When is the last time there was a garage there? All I'm saying if it looks like green space then the council may well say we only want it used as green space. You can obviously prove you own it but that's not the point.

    Thank you again, forgive me but I'm missing something whats is the point. There was never a garage there its was part of the house deeds when I purchased the house. Its on the freehold on the property, I not looking to build a garage but remove the grass area and tarmac the section allotted as my property to park a car on it. I just assumed that if you purchased land its yours. i agreed that the council took it on themselves to include this plot in there grass cutting in the area. But I cant see why I don't own the land and use as such I know I missing your point so if you don't mind please expand thank you.

    You will need to obtain planning permission to park a car there, that's all.

    As Angry bird has explained, very possible planning is required. You would need to speak to the local planner or engage a local engineer/architect/technician to explore the possibilities.
