Myself and my husband have a joint tenancy on a council house in cavan. We are going through a hard time at the minute and i am considering moving back to dublin with our four kids. Although we would have shared custody of the kids and will have them every weekend and school holidays etc. Will the council make him leave the house.
if they did he would have nowhere to live and although we arent happy at the minute i would not like to see him homeless. And i need to take my name off the house to go on the housing list in dublin.
has anybody had experience of this ?

    Not a chance

If anything his rent will go down.

He needs the house for accommodation of the kids at the weekend.

The council will be very sensitive on this speaking from expedience

It's possible they may ask him to move to a smaller property I know it happened to a friend recently ,
You would be looking at a 10+ year wait for a house in dublin and then you have a feck all landlords accepting rent supplement at the moment .
It may be an idea to suggest he moves out

Its the place itself that is causing us the most problems so i would need to move to dublin to be closer to my family cos i am isolated down there with his very unsupportive family. We have put an awful lot of money into the house in the 5 years were there,we have never had any complaints and our rent has always been in credit. Would this stand for us..could he have the rent adjusted so he remains paying rent for the children ?

If you take your name off the house, you will not be provided with anything!! There are families living in hotel rooms. You've no chance of getting council housed in Dublin. You also won't be eligible for rent allowance unless you are homeless

Think very carefully about your next step

The council have said if i take my name off the tenancy i can apply to relevant county council and go on the list and claim rent allowance as a new applicant. But letting him keep the house would be my big question

What people are trying to get across is you're very unlikely to find a place in Dublin that accepts RA.

It seems he would keep the place, according to other posters

But you can also be turned down from the housing list in dublin because you walked away from a council house already you can also be denied rent allowance for same reason

This is what I was tiring to get across, you also have to be in the county for 12 months before you can apply

Seriously OP I know it wasn't your question but the housing situation in Dublin is worse than I've ever seen it. Unless you have somewhere already lined up that will take rent allowance don't move to Dublin you'll end up in a hotel.

The OP has to be first on Dublin City Council housing or homeless list before meeting the criteria to be accepted for rent allowance. As the OP is in a council house in Cavan s/he is not eligible to go on said housing list. Therefore, the OP is not entitled to rent suppliment.
