Unsolicited Charges

    I signed up to a fuel card several years ago on the basis that there was no annual fees, minimum spend etc.
    Basically the sales pitch was that you could use the card when the card price was cheaper than the forecourt price, and when the forecourt price was cheaper you could pay at the forecourt.

    After a period of time the fuel card company started charging an annual fee for the card. First 9 euro per year and then 15 euro per year.

    My question is; can a company spontaneously start charging for a service that was "free" before?

    Do they not have to give prior written notice?
    Do they have to have something like this in their terms & conditions?
    Can I demand to see proof of my acceptance of these terms & conditions?
    If the company changes hands prior to this change in service, does the "new" company have to get me to agree to their terms & conditions? (If the new t&c's are different?)

    If you are aware a charge exists for a service and you continue to use that service, then you have implicitly agreed to pay the charge which arises.

    It doesn't require your explicit acceptance, even where a service which was once free starts levying a charge.

    If you were unaware that they were planning to charge for this card then send them a response telling them you were unaware a charge now existed, and to cancel your account with immediate effect.

    I use the term "unaware" specifically there because they don't necessarily have to have sent a direct personal communication to this effect. If you became aware through advertisements, news articles or other means, then you are liable for the charges.
