    Hi, doing some research on grave yards. Can anyone recommend a good legal text to consult.

    What legal angle on graveyards are you researching? Why would anyone write a 'legal text' about cemeteries?

    Hi, I am looking at the environmental impact side of things. I don't expect to find a full legal text on Grave Yards as I am aware that the majority of legislation is from 1800's (amended by SI's) but I was wondering if anyone had come across any legal texts which referred to them.

    Offhand, I know of no text dealing specifically with your area of enquiry.

    I suspect that you need strands of relevant information from multiple sources to complete whatever you are researching.

    Generally, I would expect much of what you are looking for to be under the subject area of public health. So, any textbooks in that subject area might help.

    Also, look at the various Public Health Acts.

    For instance, look at the Public Health (Ireland) Act 1878. Look at Part III - BURIAL GROUNDS which runs from S. 160 to S. 199. Here you will distil many little gems.     Yes that act is still in force.

    The main legislative provisions for graveyards and buriels is the Rules and Regulations for the Regulation of Burial Grounds 1888. It is still in force today but I don't think it is on the statute book to view and I'm not sure where it may be available to view.

    S. 182 covers exemption of burials from toll as follows ;

    182. No funeral procession, or carriage in such procession, and no foot passenger, shall, while going to or returning from the place of interment on the occasion of any interment, be liable to any toll or pontage.

    Would that apply to our modern toll bridges ?

    I spotted a BMW 5-series estate for sale a while ago that had been converted into a hearse for tax-dodging purposes. I wonder did the owner put an empty coffin in the back for toll free driving as well...
