Paying an "accompanying" driver

This follows on from a discussion on another thread when someone asked for people to help them practice and offered to pay them. I'll link it back when I'm on my PC, I can't do it from my phone.

I sought clarification from the RSA and eventually got the answer I expected to get. I'm posting the email exchange purely to make people aware of the situation.

    Hi

Is it legal for a learner to pay a non-ADI for accompanied practice?
If not, and I'd assume it wasn't, could you point me in the direction of any information/legislation please?

    Regards

    Hi Mascot

A driver can only complete the EDT lessons with an approved ADI. Anybody with a full licence in this category for at least 2 years can provide sponsorship or can accompany the Learner driver for practice. If the learner driver pays the full licence holder for this practice there are no regulations preventing this. This is a matter between the learner driver and the person accompanying them for the practise.

    Hi S

    Thanks for clearing that up.
In theory, anyone can then charge a learner for lessons as long as they got their learner permit prior to April 2011 which is surely contrary to the purpose of setting up the ADI system! They simply need to claim they're accompanying them.

    Hi Mascot

There is a bit of confusion here. The only person who can charge a person for EDT lessons is an ADI instructor. There may be lessons done in between EDT lessons but these need to be completed by a qualified ADI.

On 1 May 2009, it became an offence for a professional instructor to teach someone to drive unless the instructor is on the RSA's Register of Approved Driving Instructors.

    Hi J

I'm not confused. I'm highlighting what I see is a bit of a flaw in the system which could be open to abuse.
There are learner drivers online asking for fully licensed drivers to help them practice and in return they will pay them.

I was under the impression that nobody could help learners for "hire or reward" unless they were a registered ADI hence my original query.

    Hi Mascot

Anyone giving lessons that isn't a Qualified ADI and they are getting paid these are illegal lessons and you can report them to us.

I meant there was confusion in the response back to you from us.

    J
