Maintenance and who pays for what?

    I ended my relationship with my ex-husband in Spring 2014 after a few months we went into mediation and continued this process for over a year before he ended it abruptly and with no explanation. He then commenced legal proceedings. During this time he continued to live in the family home and he finally moved out (guards told him to) shortly before It was finally settled out of court in Dec2015. During the process I have tried to be as amicable as possible for DD s sake however he seems hell bent on making this situation as bitter as possible (spreading untrue rumours, lying to our daughter, refusing to bring her/pay for to activities which she has been doing since before the split etc)

    He does pay 100 per week maintenance - 45 of this goes to her weekly activities, pocket money etc Remainder goes on food and ESB bill. The children s allowance goes into a joint account with his and my name on it. It s for DD s education but I cannot access this money without his signature.



    What is really getting to me at the moment is that when she has access with him (every other weekend) he is returning her clothes after filthy and often with permanent staining. He asked for extra visitation (wasn t his weekend) the day after her communion (he got to see her on the day also, take pictures etc). I cancelled plans so they could spend time together. He asked that she be dressed in her communion dress, have hair done etc. I agreed. When I got the dress back (cost 225) there was a large hole in the side. DD said she snagged it on the radiator in the hall but that when she snagged it, it was only a small pull. (the hole is circular and about 2.5 inches) The dress shop said they cannot repair it. He had agreed to contribute 250 towards her communion costs which he never paid. (total cost was 1500) I am still waiting on 50% of last year s back to school money, doctors etc.


    [font=Calibri","sans-serif]My question is .Am I obliged to pay for all clothes, shoes, activities etc when DD is with her dad? She swims and pony rides on Saturday mornings and doesn t want to stop doing them. He will only bring her if I pay for them. If I refuse he tells DD that I am being mean and wont pay for her to go. Also as regards toiletries, clothes etc. must I provide all of them and replace when they are soiled/damaged/outgrown? Also things she got from santa like bikes are they restricted to the parent s house that bought them? This week the school asked for kids to bring in their bikes for a one day outing. She has outgrown the one I bought her so she asked if she could use the one in her dad s house. He refused and I ended up having to buy a new bike (had to borrow for it as I have so many expenses coming in atm) My ex maintains that what I buy for DD is hers and must be passed between both homes but what he buys belongs to his home. Seems pretty unfair. He got a lot of money from his share of the house (rounded up was slightly over 50%) and was given a house by his family so he has no mortgage. He earns same basic pay as me but he does a lot of overtime so he is not short of money by any means. I also know and can prove he lied on his Affidavit of means[/font]
