Adverts.ie and faulty goods

    Hi All,

    I've bought an Iphone on Adverts, the phone from the outside is spotless, works fine aside from one thing. I can't make or receive phone calls due to the noise in the handset.

    I've researched this issue and there is no definite fix, even Apple can't seem to give an answer.

    I've contacted the seller, he is looking into it, he was coming back form holidays on Tuesday. I've sent him 2 messages through adverts since his last reply and got no answer.

    What's my next step? Message him again, ask for a refund? Give him a timeline to respond and then take it to Paypal (I paid with Paypal, using my credit card)?

    How much time would you allow for response before contacting Paypal?

    I think I've found his phone number online, would you try calling it or stick to PM's on Adverts?

    Open a case straight away with PayPal
    It's a long process so may as well get the ball rolling

    I'd allow 7 days from the time you bought it, then open a paypal dispute. That lets him know you're serious and as paypal is buyer leaning it should fairly light a fire under him.

    Open a dispute asap as it take time before you can escalate and five the seller time to respond

    If you're still having issues with the seller, drop us an email on support@adverts.ie with a link to the ad. Don't wait any longer to open a dispute/case with PayPal too

    Does the seller have to actually do anything here? The purchaser should have fully checked the phone before buying it. I guess it might depend on the text of the ad. But buyer beware and all that.

    Buyer beware ?
    The seller is at fault if he listed it as a working phone he should check it's working before listing it for sale

    Buyer has 6 months to return an item with PayPal if its faulty

    Morally you're probably right, but legally I'm not sure there is much the buyer can do against an individual (as opposed to a professional vendor).
    Paying with PayPal was sensible in this case, but their service goes beyond the legal minimum and effectively begin a case against the seller, I think.

    he has to refund the paypal payment on return of the faulty phone
    thats the whole idea of paypal to cover yourself and that cover lasts for 180 days

    Consumer law and Paypal's terms are two separate things, and Paypal does have a policy that protects buyers from faulty items like this, regardless of whether the seller is a business or a private individual. Consumer law does apply in the case of a private sale, but in a greatly diminished capacity.
