Interception communications and covert electronic surveillance legislation?

    Minister Fitzgerald is to propose an update to the legislation for the lawful interception of communications and for covert electronic surveillance.

    What powers are required by the Gardaí they don't have now?

    That's what I'm wondering, what rights have the Gardaí now and what rights have citizens now.

    The Criminal Justice (Surveillance) Act 2009 gives them extensive rights to intercept communications and the Data Retention Act gives them access to information about your past activities gathered and held on their behalf by phone companies and Internet service providers. This would include your movements, who you called or mailed and what websites you visited.

    As for rights, you have no right to know if they have accessed your data.

    The Data Protection Act is being challenged as the ECJ has ruled that similar laws elsewhere lack proportionality and breach EU rights

    It's possible that the governement will use the gang crisis to justify the continued retention of all citiizens phone and ISP metadata.
