Accident with no NCT

    Hi All

    Bought a car last month with a very short NCT . Never got around to testing it or booking a test. Had a small accident and am without blame but the NCT expired 3 weeks before the accident. Am I still insured ?

    If you're without blame it'll be the other person's insurance paying out.

    Hi there. I have not had a chance to check. Was waiting to see my solicitor today but he is off for a few days. Just a bit worried. The guards were not called to the scene but there may be a claim.

    the roadworthiness or not of your car didn't cause the accident as you are without blame, ipso facto your car is also without blame

    Happened my sister. She had no tax or nct (both were well out) and she t boned a Land Rover which pulled into her path.The Land Rover was at fault. The insurance paid out for her car which was a write off, but they said they would have given more if it was nct'd. She still got a fair price for it.

    The guard rang my father that evening while my sister and nephew were still in the hospital as a courtesy call. He mentioned the tax and nct. I had put an engine into the car 2 weeks previous and had a receipt for the engine from a breakers. Quick as a flash the auld lad told the guard it was off the road for ages and just had the engine fitted. The guard was happy with that and didn't do her.

    What condition is the car in, ie has it any major defects like bald tyres etc? The insurers would normally send out someone to inspect your vechicle. The other insurer will pay out but they might try to low ball your car value with no valid NCT.

    so if you should have not been on the road, then the other car would not have hit you, had you not have been on the road

    Doesn't matter. If he is insured and has working lights and good tyres, he'll get paid out for the damage.

    There's a possibility of 5 points for no nct though. Were the guards involved at all?

    it's 3 points nowadays....used to be mandatory court appearance and 5 points on conviction. Now 3 points at the roadside

    Most policies require the vehicle to have a NCT to be valid.

    It doesn't matter if op was insured or not, as its not his fault so other party insurer will be paying

    Who is claiming from whom? Has the other party admitted responsibility and is their insurance ok with that?

    No guards as of yet.

    Don't know if their insurance company is ok with it or not but the driver signed a note that he would pay.

    Spot on . All sorted. Got paid a fair price for the car. I was advised to go to Gardai myself but they showed little interest. All Finished now anyways.
